Google AI Services
As a user of the SundaySky Platform, Customer and its Users (“you”) may elect to use Google’s generative AI service, Imagen and potentially other Google AI services (together, the “Google AI Services”) to generate images from text prompts provided by you as part of use of the SundaySky Platform for inclusion in your Videos.
SundaySky makes the Google AI Services available to you on the same terms as you would receive if you contracted directly with Google. By using the Google AI Services you agree to comply with the following Google terms: Google Cloud Platform Terms currently located at https://cloud.google.com/terms/services;
Google Service Specific Terms for AI Services currently located at https://cloud.google.com/terms/service-terms; Google Generative AI Use Policy currently located at https://policies.google.com/terms/generative-ai/use-policy; and each of the other policies and terms references in those terms, as they may be in effect from time to time (together, the Google Terms”).
If you believe you have a claim under the Google Terms arising from your permitted use of the Google AI Services with the SundaySky Platform, you must give SundaySky prompt written notice of that claim. SundaySky will use reasonable efforts to seek indemnification from Google on your behalf and will pass through to you the indemnification (if any) SundaySky receives from Google in respect of such claim. The foregoing is SundaySky’s sole obligation and liability to you in connection with the Google AI Services. SundaySky makes no representations or warranties regarding the Google AI Services or your use of the Google AI Services in connection with the SundaySky Platform, and SundaySky reserves the right to discontinue making the Google AI Services available to you as part of the SundaySky Platform at any time.
